Marc joined THE GARBER LAW FIRM PC in January 2003, after having spent nearly nine years as an Assistant U.S. Attorney with the United States Justice Department and working at Gibson Dunn & Crutcher and Alston & Bird.

Marc's versatility and effectiveness as both a Criminal Defense Attorney and an Employment and Labor Lawyer has earned him the title of one of Georgia's "Legal Elites" by Georgia Trend Magazine in both categories.

Marc has successfully handled more than 50 criminal and civil trials, almost all by jury, and appeals in federal and state courts throughout the United States, including the Supreme Court of the United States.  His cases have taken him to courts in Georgia, Florida, Alabama, Louisiana, South Carolina, New Jersey, New York, Pennsylvania, Ohio, Colorado, California, Nevada, Missouri, and Tennessee.
 
Marc’s criminal practice covers fraud, drug crimes, federal felonies, theft, embezzlement, mortgage and bank fraud, forfeiture, money laundering, white collar crimes, arson, violent felony crimes, healthcare fraud, pharmaceutical and environmental offenses, the FBI, the DEA, the IRS, and the police.

His civil practice focuses on commercial and business disputes, non-compete agreements and confidentiality contracts, class action wage and overtime and employment litigation, discrimination cases, RICO lawsuits, and whistleblower claims under federal and state law.  Marc’s practice also includes representing physicians involved in disputes with insurance companies, state and federal regulators, the U.S. Department of Health and Human Services and the Centers for Medicare and Medicaid Service.

Marc has won criminal trials charging wire and mail fraud, drug dealing and narcotics distribution, assault and battery, money laundering, arson, Medicare and Medicaid fraud, bank fraud, mortgage fraud, insurance fraud, healthcare fraud, and environmental crimes.

He has also won suppression motions to exclude evidence from trial that had been seized under illegal search warrants and illegal warrantless searches. Marc has also convinced prosecutors to drop federal grand jury investigations with no charges filed involving possible customs violations, bank and mortgage fraud, government-contractor billing practices, and money laundering.

Marc has also successfully defended charges and indictments for mail and wire fraud, healthcare fraud, insurance fraud, Medicare and Medicaid fraud, bank and mortgage fraud, pharmaceutical fraud, environmental violations, customs fraud, tax fraud and money laundering.  In illegal narcotics and drug cases, Marc has successfully handled drug charges involving cocaine trafficking, marijuana distribution, methamphetamine, heroin, and ecstasy.

A number of Marc’s criminal and civil cases have garnered the media’s attention.  The most widely covered involved a lawsuit against Coca-Cola. The case was covered by The New York Times, CNN, USA Today, Forbes, The Washington Times, and also received international coverage from England to China.

Marc has also spoken and written on a wide variety of legal subjects, and has periodically provided legal analysis for CNN and Fox News.  Some of Marc’s publications include:

Following law school, Marc clerked for United States District Judge Jerry Buchmeyer in the Northern District of Texas.

Marc received his law degree cum laude in 1985 from the University at Buffalo, State University of New York, where was an editor of the Buffalo Public Interest Law Journal and a Moot Court board member.  He graduated from the Wharton School, University of Pennsylvania, with a bachelors of science in economics in 1982.
