Mr. Schulkin focuses his practice on environmental and insurance coverage matters. He frequently represents both plaintiffs and defendants in environmental cost recovery actions. His work also has included defending clients against toxic tort lawsuits, class-action litigation and claims involving alleged violations of waste disposal, water quality and air emissions regulations. He is adept at understanding scientific and technical issues and has handled matters involving soil contamination, groundwater pollution and vapor intrusion.

Mr. Schulkin regularly advises clients on environmental permitting, liability and clean-up issues. As part of this work, he has negotiated agreements with state and federal environmental agencies and represented parties in agency proceedings. In addition to environmental matters, Mr. Schulkin has experience assisting clients with insurance coverage issues, business disputes and bankruptcy matters.

His significant accomplishments include:

• Obtained an early dismissal of a toxic tort action filed in federal court; the case was refiled in state court and settled for a nominal amount.
• Represented the prevailing plaintiff in a successful CERCLA contribution action.
• Defended RCRA and toxic tort class action litigation which resulted in a favorable settlement for the client.
• Persuaded the Kansas Court of Appeals to affirm a district court decision that was challenged on appeal.
• Assisted in obtaining insurance coverage for clients named as defendants in multimillion-dollar environmental and toxic tort lawsuits.
• Served as claims counsel for the debtor in one of the largest bankruptcies in United States history.
