Representative Matters Legal Malpractice and Commercial Litigation – Obtained legal malpractice settlement on behalf of client and negotiated settlement of litigation with commercial tenants with an obligation to pay in excess of $1.5 million in lease payments through the balance of the lease. Tenants also paid over $300,000 for environmental cleanup.
Business Representation – Obtained breach of contract judgment in excess of $1.4 million in a real estate transaction and obtained a property tax refund in excess of $300,000 on commercial property. Successfully negotiated release of liability for real estate loans held by five financial institutions with aggregate principal in excess of $20 million.
Corporate Fiduciary Litigation - Successfully defended several members of the board of directors of a major hotel chain against allegations of fraud and abuse relating to insurance policies on more than $1 billion in properties.
Employment Law - Obtained and collected more than $435,000 from prior employer for improper enforcement of employee non-compete. Included $300,000 in punitive damages.
Business Broker Representation - Obtained a jury verdict and collected approximately $985,000 in brokerage fees and attorneys’ fees due to a business broker for the sale of a business. Received a fee award for 100% of the hourly rate.
Bad Faith Insurance - Negotiated a $2.5 million bad faith insurance settlement with an insurance company after obtaining a 43-page summary judgment ruling from Federal Judge Carl Muecke on liability for bad faith (approximately one year after insurer offered $10,000 and we countered to settle for policy limit of approximately $165,000). Insurer also paid $165,000 policy limit when Summary Judgment was rendered.
