Evan D. Evan has developed a reputation as a skilled and polished litigator, who fights for full justice for all of his clients. He does so regardless of the size and power of his adversaries, who will often spare no expense to deny, delay and refuse to pay for the damages they cause to the public.

Recently, Evan, along with his Partner, Ty G. Roland took on one of the largest corporations in the world. When Wal-Mart refused to offer a fair settlement to a client who was catastrophically injured in one of its stores, Evan and Ty, refused the insultingly low offers, and let a Lee County jury resolve the dispute. The result, was the largest slip and fall verdict ever rendered in the county. Wal-mart insisted throughout the case that they had a multitude of rules in place to prevent these types of incidents in its stores. Evan and Ty conceded and commended the retail giant for having these rules in place, but proved to the jury that it was Wal-Mart’s needless failure to follow its own rules that directly lead to the permanent and disabling injuries that their client will have to endure for the rest of her life. While nobody will ever be able to give this client her health back, as a result of the jury award, at least she won't have to worry about how she will pay her medical bills and help put food on her family’s table. Evan is a past President. of the Cape Coral Bar Association and a member of numerous legal organizations, including; the Florida Justice Association; the Southwest Florida Justice Association; and the Lee County Bar Association. Evan is extremely active in the local community, a former Rotary Club member, who has frequently lectured and held numerous complimentary seminars for local doctors and lawyers, keeping them up to date on important issues affecting their practices.

Verdicts:

  • $2.1 million dollar jury verdict for child who suffered a traumatic brain injury as a result of negligence of maintenance worker at an apartment complex – October 2008.
  • $ 1 million dollar jury verdict for woman who sustained serious cervical spine injuries requiring multiple surgeries and implantation of a permanent titanium cage after slip and fall incident at a Wal-Mart store. – July 2008.
  • $ 2 million dollar jury verdict for man who was improperly terminated from his employment in violation of the Americans with Disabilities Act (ADA). 
  • $200,000 plus jury verdict for man who was involved in a head on collision with a Fort Myers police officer resulting in disabling lumbar spine injuries.
  •  100% of Disputed Insurance Benefits awarded by jury to a man whose insurance company refused to pay reasonable, related and necessary medical expenses incurred as a result of serious motor vehicle accident.

Settlements:

  • $975,000 settlement for woman who sustained neck and head injuries after being ejected from her car during a rollover collision.
  • $ 1 million dollar settlement for a man who sustained face and head injuries resulting in permanent scarring after being involved in motor vehicle crash while on vacation in SW Florida. 
  • $550,000 settlement for family of man who was a victim of nursing home abuse and neglect, resulting in multiple falls, hip fracture and death.
  • $600,000 settlement for a woman who underwent multiple spinal surgeries as a result of a motor vehicle crash that left her vehicle a total loss in addition to rendering her permanently disabled.
  • $400,000 settlement for woman with neck and back injuries following serious motor vehicle crash. 
  • $350,000 settlement for man who sustained severe knee injuries resulting in multiple surgeries, including total knee replacement following t-bone collision.
