Alan Windham is an associate in the firm's Litigation Section. He represents clients both in trial and on appeal in the state and federal courts of both Mississippi and Alabama. His practice includes the following areas:

Real Estate Litigation
Mr. Windham represents title insurers, title agents, insured lenders, and insured owners in litigation and claims arising from real estate transactions. Representative matters include the curing of title defects, litigating cases both in Circuit and Chancery Court, and defending insurers in coverage disputes. Alan also represents condemning authorities in eminent domain actions. He was one of a team of attorneys who represented a major pipeline in its proceedings to condemn property related to a pipeline project that began in Oklahoma, passed through Arkansas, Texas, Louisiana, Mississippi, and Alabama. Alan is also the author of the Mississippi section of the American Bar Association's compendium of eminent domain law for the fifty states.

Commercial Litigation
Mr. Windham represents companies and individuals in commercial and business lawsuits and arbitration proceedings. Alan has represented clients in disputes between minority and majority shareholders in closely held corporations, evictions, wrongful foreclosure actions, business suits in equity, construction litigation, and collection actions. Alan has represented multiple clients in arbitration proceedings under various arbitration rules, including the rules of the American Arbitration Association.

Healthcare Litigation
Mr. Windham represents healthcare companies in various types of litigation and other contested matters, including the defense of medical malpractice and other professional negligence cases. Alan also represents healthcare clients in administrative proceedings to obtain Certificates of Need.

Products Liability and Casualty Litigation
Throughout his career, Mr. Windham has represented clients in both Mississippi and Alabama in complex litigation and mass torts involving asbestos, pharmaceuticals, and industrial chemicals. Alan also has extensive experience in other areas of law involving personal injuries and property damage, including oil and gas litigation, admiralty and maritime litigation, and general personal injury litigation. Alan was one of a team of attorneys who successfully obtained a defense verdict for a multinational oil and gas company where it was alleged that it purposely converted gas and punitive damages were sought.
